TERMS OF SERVICE

1. INTRODUCTION

Welcome to Asian Art Bridge ("Asian Art Bridge", "AAB", "we", "our", or "us").

Asian Art Bridge is a museum-grade curated art platform dedicated to modern and contemporary Asian art. The Platform combines curatorial expertise, online commerce, private sales, electronic brokerage and art advisory services to connect artists, galleries, collectors, institutions and art professionals worldwide.

Our mission is to promote museum-quality Asian art through rigorous curatorial standards, verified provenance, authenticity review and responsible market practices.

Unlike a traditional online marketplace, every artwork published on the Platform undergoes a curatorial review. Publication of any artwork remains at the sole discretion of Asian Art Bridge.

By accessing or using the Platform, you agree to be bound by these Terms of Service.


2. DEFINITIONS

For the purposes of these Terms:

Artwork means any original artwork, limited edition, sculpture, installation, photography, print or cultural object offered through the Platform.

Platform means the Asian Art Bridge website and all related digital services.

Seller means any artist, gallery, collector, institution or authorized representative offering an Artwork.

Buyer means any person or legal entity purchasing or making an offer for an Artwork.

Art Expert means an independent curator, historian, scholar, specialist or ambassador collaborating with the Platform.

Private Sale Session means a confidential negotiated sale facilitated by the Platform.

Offer means a purchase proposal submitted through the "Make an Offer" feature.


3. OUR ROLE

Asian Art Bridge operates as a museum-grade curated art platform specializing in modern and contemporary Asian art.

The Platform combines:

  • museum-level curatorial selection;
  • online commerce;
  • private sales;
  • electronic brokerage services;
  • business introduction within the art market;
  • strategic art advisory services.

Depending on the nature of each transaction, Asian Art Bridge may act as:

  • a curated online marketplace;
  • an intermediary facilitating transactions between Buyers and Sellers;
  • a provider of strategic consulting and business development services within the art market;
  • an organizer of private sales;
  • an operator of electronic brokerage services relating to works of art and cultural property;
  • or, where expressly stated, the direct seller of an Artwork.

Asian Art Bridge is not a public auction house unless expressly indicated.

Private Sale Sessions, negotiated sales and electronic offers available through the Platform do not constitute public auctions.

Asian Art Bridge retains complete editorial and curatorial discretion regarding the acceptance, publication, suspension or removal of any Artwork, artist, gallery or collection.


4. CURATORIAL SELECTION

Every Artwork submitted to the Platform is reviewed according to Asian Art Bridge's curatorial standards.

The review may include:

  • artistic quality;
  • historical relevance;
  • provenance;
  • authenticity;
  • exhibition history;
  • bibliography;
  • condition;
  • documentation;
  • market relevance.

Publication on the Platform does not constitute a guarantee regarding future market value or investment performance.

Asian Art Bridge reserves the right to decline any Artwork without justification.


5. PROVENANCE & AUTHENTICITY

Asian Art Bridge places particular importance on provenance and authenticity.

Where applicable, the Platform reviews available documentation including:

  • certificates of authenticity;
  • provenance records;
  • exhibition history;
  • scholarly publications;
  • literature references;
  • expert opinions.

Art historical research continuously evolves.

Accordingly, expert opinions may change over time following new discoveries or scholarly research.

Unless expressly stated otherwise, Asian Art Bridge does not provide a perpetual legal guarantee of authenticity.


6. ART EXPERTS

Asian Art Bridge collaborates with independent curators, art historians, scholars and recognized specialists.

Their role may include:

  • curatorial selection;
  • authenticity assessment;
  • provenance research;
  • cataloguing;
  • scholarly review;
  • market analysis.

Expert opinions represent professional assessments based upon information available at the time of review.

They do not constitute legally binding warranties.


7. BUY NOW

Certain Artworks may be purchased immediately through the Buy Now feature.

An order becomes legally binding only after:

  • payment has been successfully received;
  • artwork availability has been confirmed;
  • the Seller has confirmed the transaction where applicable;
  • Asian Art Bridge has approved the transaction.

Asian Art Bridge reserves the right to refuse or cancel any order in cases including but not limited to:

  • prior sale;
  • pricing errors;
  • authenticity concerns;
  • legal restrictions;
  • export restrictions;
  • force majeure.

8. MAKE AN OFFER

Certain Artworks may be available through private negotiation.

Submitting an Offer does not create a legally binding contract.

The Seller may:

  • accept the Offer;
  • reject the Offer;
  • submit a counter-offer;
  • allow the Offer to expire.

Only written acceptance communicated through the Platform creates a binding agreement.


9. PRIVATE SALE SESSIONS

Asian Art Bridge may organize confidential Private Sale Sessions.

These sessions may include:

  • negotiated pricing;
  • confidential discussions;
  • expert consultation;
  • provenance review;
  • condition review;
  • documentation exchange.

Negotiations remain confidential unless disclosure is required by law.

Asian Art Bridge reserves the right to terminate negotiations at any time.


10. PRICING

Artworks may be offered through:

  • Buy Now;
  • Make an Offer;
  • Price Upon Request;
  • Private Sale.

Prices may be modified before a legally binding agreement has been concluded.

Applicable taxes, customs duties, shipping costs, insurance and import charges remain the responsibility of the Buyer unless otherwise agreed.


11. PAYMENT

Payment methods are indicated during checkout.

Ownership transfers only after full payment has been received.

Failure to complete payment may result in cancellation of the transaction.


12. SHIPPING

Shipping arrangements vary depending upon the Seller and destination country.

Asian Art Bridge may coordinate logistics but does not necessarily perform shipping services.

Insurance, customs formalities, export licences and import duties remain subject to applicable legislation.

Risk transfers according to the shipping terms agreed between the parties.


13. EXPORT OF CULTURAL PROPERTY

Certain Artworks may require export licences or governmental authorization.

Completion of the transaction may be delayed pending issuance of such authorizations.

Asian Art Bridge shall not be liable for delays caused by governmental authorities.


14. CONDITION REPORTS

Condition reports are prepared in good faith.

They represent professional opinions based upon visual examination.

Condition reports do not constitute warranties.

Buyers are encouraged to request additional information before completing any purchase.


15. RETURNS

Because original works of art are unique objects, completed sales are generally final.

Returns are accepted only:

  • where required by applicable law;
  • where expressly agreed in writing;
  • or where an authenticity claim has been accepted following the Platform's review procedures.

16. SELLER WARRANTIES

Each Seller represents and warrants that:

  • they own the Artwork or are authorized to sell it;
  • the Artwork may lawfully be sold;
  • provenance information is accurate to the best of their knowledge;
  • known condition issues have been disclosed;
  • intellectual property rights are respected.

17. USER ACCOUNTS

Users agree to provide accurate information.

Asian Art Bridge may suspend or terminate accounts engaged in fraudulent, abusive or unlawful activities.


18. ART ADVISORY & BUSINESS INTRODUCTION SERVICES

In addition to operating the Platform, Asian Art Bridge may provide strategic consulting, art advisory, sourcing, business introduction and market development services within the international art market.

These services may include:

  • artwork sourcing;
  • collection development;
  • acquisition advisory;
  • institutional partnerships;
  • gallery representation;
  • artist promotion;
  • business introductions;
  • exhibition consulting;
  • market development strategies.

Such services may be subject to separate agreements and separate fees.


19. INTELLECTUAL PROPERTY

All images, catalogues, texts, curatorial essays, logos and website content remain the intellectual property of Asian Art Bridge or their respective owners.

No reproduction or commercial use is permitted without prior written authorization.


20. LIMITATION OF LIABILITY

Asian Art Bridge acts in good faith in reviewing Artworks and facilitating transactions.

Except where prohibited by law, Asian Art Bridge's liability shall be limited to the amount actually paid in connection with the relevant transaction.

Asian Art Bridge shall not be liable for fluctuations in market value, investment performance or future scholarly opinions concerning an Artwork.


21. PRIVACY

Personal data are processed in accordance with the Platform's Privacy Policy.


22. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of France.

Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France, unless mandatory consumer protection laws provide otherwise.


23. MODIFICATIONS

Asian Art Bridge reserves the right to amend these Terms at any time.

The most current version shall always be published on the Platform.

Continued use of the Platform constitutes acceptance of the revised Terms.
